Conditions of Use

1. Validity

Our offers and services are based on these conditions of use exclusively. We are only accepting different conditions when they are fixed in writing.

2. Offers

Our offers and prices are without obligation and reserved to be changed. The agreement is legally binding when after we fixed it in writing or send the ware. The prices are in gross and Euro, with 19% tax included. Customers of foreign countries will be charged the net ammount.

3. Prices

You have the choice to order by advance payment and "paypal". Please use following bank account for payment:

4. Shipping

4.1. Terms of Shipping

The ware will be delivered within three to four days, normally. If there should be a delay we appreciate your comprehension, we will send you the approximately deliverydate, as soon as possible. If a product couldn´t be delivered anymore will send you a notice to vacate. You`ll get a chargeback of those iteams immediately. If you would have the package within one day (national) and three days (international) we have the possibility to send you the ware by express-service. Therefore we will calculate the transport-costs individually and reconfirm the price with you.

4.2. Dispatch and passage of the risk

As soon as goods are given to the transportation company, they are responsible for the goods.

4.3. Transportation

Bayerische Geschenke have the choice of transportation.

4.4. Duty

Customers are responsible for the buty by themself. Bayerische Geschenke won´t be responsible for non-observance.

4.5. Shipping costs

To keep the prices as low as possible we have to charge you transportation costs. The costs are 4,90Euro for national orders, 15,- Euro for Europe. The Shipping cost in the other contries are different. We send You a email about the price. There are additional costes for c.o.d. - 4,- Euro in Germany. If your order is more than 80,- Euro (for Germany no c.o.d.), 150,- Euro (for Germany with c.o.d.) we won´t charge you transportation costs.

5. Notices of defect, guarantee and compensation

If packages are damaged obviously, you have to open it at the handover with the transportation company. If the ware is damaged, please contact us via mail or fax and send us the package back, unfree. You will get replacement immediately.

6. Fair trading cancelling / non-acceptance

You have the right sending us back the ware within 14 days. Therefore you have to pay the transportation costs. If you have used or opened (e.g. Brennerei Adelsberg products) the ware your buy is binding. Please send us back the articles to:

You have to secure the set term and take care for save transportation. If there is a depreciation you will be charged the amount of it.

7. Terms of payment

The invoice have to be payed within 14 days. The invoice will be issued in Euro. Foreign checks will be accepted for an handlefee of 5.- Euro.

8. Retention of title

The products are our property till the invoice will be payed in total.

9. Data Protection

We keep your data protected against usage of thirt parties. We only use it to handle your order, therefore we have to save them.

10. Place of delivery and area of jurisdiction / Final clauses

Any agreements are based on german law. If a customer has no accomodation in germany the legal domicile of Bayerische Geschenke will be the place of jurisdiction.
